Broome puts limits on sex offenders
New law restricts travel, residences for Level II

Broome County legislators on Thursday approved a countywide law that would restrict where sex offenders can live and travel, but how the law will be enforced was not addressed in the legislation.
Legislators voted unanimously to keep Level II sex offenders -- those classified as moderately at risk to re-offend -- away from school grounds, public parks and day care centers in Broome County. State laws already impose restrictions on the residency and travel of Level III offenders, classified as high risk to re-offend.
The county law will not supersede local laws passed by towns, villages and the City of Binghamton, legislators said. About half of Broome County's 23 local municipalities have laws restricting where Level II sex offenders live and travel, said Jerry F. Marinich, R-10th district.
The City of Binghamton also has adopted its own local laws.
Under the county law, Level II offenders cannot live within 1,000 feet of any school grounds, day care facility or public park. Penalties for violating the county law include a fine of up to $500 and jail time of up to six months for a first-time violation of the law.
A third conviction violating the county law carries a fine of up to $1,000 and a six-month jail sentence, according to the resolution. The law applies to Level II sex offenders who own homes, live with relatives or who rent.
The question of who will enforce the law remains up in the air. There are no plans by the legislature to hire additional Broome County sheriff's deputies to take on the responsibility of enforcement, said Chairman Mark R. Whalen, D-1st District.
Nor should parents or caregivers rely completely on the county's law to protect children from offenders, one legislator said.
"I view the law as a very small thing," said Joseph S. Sanfilippo, D-4th District. "I don't want parents to become complacent."
